Roop Jewellers – TERMS AND CONDITIONS
INTRODUCTION
This account is owned and operated by Roop Jewellers having its address at New Delhi.
In using the service of Roop Jewellers, you are deemed to have accepted the Terms and Conditions listed below or as may be revised from time to time, for an indefinite period and you understand and agree that you are bound by such terms and conditions till the time you access this account. Roop Jewellers reserves the right to change these terms &conditions from time to time without any obligation to inform you, and it is your responsibility to look through them as often as possible. All rights, including copyright, in this account, are owned by Roop Jewellers. Any use of this account or its contents, including copying or storing it in whole or part is prohibited without the permission of Roop Jewellers.
ELIGIBILITY CRITERIA
Retail Jewellers who are “competent to contract” within the meaning of the Indian Contract Act, 1872 and Indian Company Act 1956 only are eligible to use this account. If your age is below 18 years you are prohibited from using/purchase from/contract with this account. Those who access this account from outside India are responsible for compliance with local laws if and to the extent local laws are applicable. In case of any Indian state prohibits the direct sale of merchandise from other states and requires special documentation to effect such a sale without dual taxation, if we receive an order from such states or to be delivered to such states under such circumstances we retain the right to accept or reject the order.
ORDER POLICY
- The order will be accepted against advance payment of 40% of the total value of the order placed.
- The order will be processed upon receipt of advance payment only.
- The order will be delivered as per the order delivery status (Product Wise).
- Please refer to the cancellation policy.
- Extra time taken for any alteration or modification in the design will be informed prior to the order being processed.
PRICING
- Our pricing is calculated using prevailing precious metal rates as per the market to give you the best possible value. When the ordered product is manufactured & before delivery, the price of the precious metal will be fixed as per the current market price of precious metal, with a mutual understanding between both parties.
- Whereas diamonds, labor, and any other add-ons (pearls, color – stone, etc.) will be fixed at the time of placing the order. Prices on the account are subject to change without any prior notice.
- The price shall be that in the seller’s current trade list price, or such other price as the parties may agree in writing. The price is exclusive of VAT or any other applicable costs.
- If payment of the price or any part thereof is not made by the due date, the Seller shall be entitled to:
- require payment before delivery in relation to any goods not previously delivered;
- refuse to make delivery of any undelivered goods whether ordered under the contract or not and without incurring any liability whatever to the Buyer for non-delivery or any delay in delivery;
- terminate the contract.
PAYMENT POLICY
– Advance payment received against the order will be incentivizing @24% p.a.
– Payment has to be made immediately on the receipt of the order items.
– Any delay in the payment will be charged at an interest of 18% p.a
– All cheque payments should be crossed and made payable to Roop Jewellers.
- Gold Payment shall be done in advance.
- Labour Payment shall be done on delivery.
DISCLAIMER OF WARRANTIES
- Where the Goods have been manufactured by the Seller and are found to be defective, the Seller shall repair, or in its sole discretion, replace defective goods free of charge within 12 months from the date of delivery, subject to the following conditions:
– Notifying the Seller immediately of the defect in writing;
– The defect due to the faulty design, materials or workmanship of the Seller.
- Any Goods to be repaired or replaced shall be returned to the Seller at the Buyer’s expense, if requested by the Seller.
- Where the Goods have been manufactured and supplied to the Seller by a third party, any warranty granted to the Seller in respect of the Goods shall be passed on to the Buyer.
- The Seller shall be entitled in its absolute discretion to refund the price of the defective goods if such price has already been paid.
LIABILITY & LIMITATION OF LIABILITY
We take no responsibility for any loss or damage suffered as a result of our ‘order online’ service, or goods supplied using it, except as required by law, even if we could have foreseen the loss, or the possibility of it being brought to our attention.
- Where any court or arbitrator determines that any part of Clause 10 above is, for whatever reason, unenforceable, the Seller shall be liable for all loss or damage suffered by the Buyer but in an amount not exceeding the contract price.
- Nothing contained in these Terms and Conditions shall be construed to limit or exclude the liability of the Seller for death or personal injury as a result of the Seller’s negligence or that of its employees or agents.
USER RIGHTS/RESTRICTIONS
Roop Jewellers reserves the right, at our sole discretion, to limit the quantity/value of the items purchased by you and such restrictions may apply to orders placed by the same account, the same credit/debit card, and also to orders that use the same billing and/or shipping address. We will provide notification to the customer should such limits be applied. Roop Jewellers reserves the right, at our sole discretion, to prohibit sales to anyone as it may deem fit.
- It is agreed by the Buyer that the Seller shall retain ownership of all copyrights, trademarks, and all other intellectual property rights in all of the Seller’s literature and websites. The Buyer is permitted to use this material only as expressly authorised by the Seller.
- The Buyer acknowledges and agrees that the material and content contained within the website is made available for personal and non-commercial use only and the Buyer may (if necessary to make a purchase on the website) download such material and content. Any other use of the material and content of the website is strictly prohibited.
- As part of this contract, the Buyer agrees not to (and to assist or facilitate any third party not to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works from the material and content contained on this website
FRAUDELENT TRANSACTIONS
Roop Jewellers reserves the right to recover the cost of goods and collect charges and lawyers’ fees from people using the site fraudulently. Roop Jewellers reserves the right to initiate legal proceedings against such people for fraudulent use of the site and any other unlawful act or acts or omissions in breach of these Terms & Conditions.
FORCE MAJEURE
Neither party shall be liable to the other for any failure to perform any obligation under this Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, Terrorism, War, Political insurgence, Insurrection, Riot, Civil Unrest, Act of civil or Military Authority, Uprising, Earthquake, Flood or any other natural or man-made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any party affected by such event shall forthwith inform the other party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained.
